The HTML 5 WG follows W3C RF Patent Policy - you can see a list of Disclosures 
here [1] (all from Apple).

The schema.org terms [2] does state that it uses a CC License (which forbids 
patents), and then goes on to say *if* there were any patents, then they would 
make them Royalty-Free.

Also, given that 3 of the biggest companies produced a one-page legal document 
- that is an achievement ;-)
