I'm able to confirm the issue for Python 2.7 and 3.x:
>>> import xml.etree.ElementTree as ET
>>> tree = ET.fromstring("<someTag>someData</someTag>")
>>> ET.tostring(tree, encoding="utf-8", method="html")
