If you mean on top of the currently selected layer, yes I agree, that's better.
What I do not like is having the new layer going to the top of the "legend"
as the only option.

But if you have the first layer selected, the new layer will not be placed on top, but one layer down.

I'm with Barry, new layers should be placed on top.
