Luckily, one of the key points in patents is that patents can not be done on something that is obvious. In other words, if there is only one way to do something and anyone would be able to figure it out, it can't be patented. I would suspect that copyright also goes along this line. Something about it having to be completely original to start with to be copyrightable.
