Depends what the purpose of the pin 1 on that chip would be.  It could 
be not used anyway, as you say.

The convention with a chip is to look at with the notch or corner mark 
at the top ( facing away from you ), and then read the pins as pin 1 
being the top left, then following around anti-clockwise for the 
remainder of the numbering of the pins ( depending on the size of the 
chip ).

On chips with many pins there are two or more ground lines, which don't 
all need to be used, for example.
