To followup on this:Robin gave me access to the machine and I was unable to get it to *fail* at which point we looked at the running configuration, which as it turns out, was using speedy-cgi. Once that was removed from the mix, tls worked just fine.
So I'll be adding some pod to suggest not using speedy-cgi and tls together...
