Ask your son what he wants......after all it is about him......if he wants 
to stay with you......work with him on a plan.  He then takes the plan 
back to dad.  If dad says no......your son has to push harder.  If still, 
a no........go to court.

Get letters from your doctor and therapists supporting your 
independence.

  Hey everybody,
  I am in a bit of a pickle and I'm not sure how to handle the situation.  
Approximately 5 days after I was in my accident, my son's father filed for 
custody.  The only thing I can remember is laying there, with a halo on, in a 
semi-drug-induced coma, thinking I didn't want my son to become a ward of the 
state.  So of course I allowed my power of attorney to sign over papers.  Now a 
little over a year and a half later I am in my own place and he is refusing to 
let my son stay here anymore than every other weekend citing that the parental 
roles are now reversed.  My ex says that I should be caring for and supporting 
our son but if he is at home with me he would be caring for and supporting me 
due to my situation (can I remind you my son is 16).  He had been getting up on 
his own for school since he was in 7th grade and there is a bus stop three 
blocks away.  He is not involved in or expected to be involved in my cares when 
he is with me, I have PCA's for that.  My ex also mentioned that he does not 
want another disruption to our sons routine (not that he didn't have to get 
used to one when I got in my accident).  Prior to my accident my son and I were 
joined at the hip and has mentioned that he would like to stay here more than 
every other weekend.  Being dependent on SSDI there's not a lot of money for an 
attorney.  Oh, and did I mention my ex and I were in the middle of a child 
support battle when I got in my accident?  He was hoping to get his payments 
reduced.  Help, I've called legal aid and they don't even have room to put my 
name on a waiting list.  Any comments or suggestions would be greatly 
appreciated.  Thank you and I apologize for the lengthy post.
