CMS is a huge organization. It is payment division for both Medicare and Medicaid. Both Medicare and Medicaid are administered by each state, as I understand. I don't know if some of the blame should be based on each state, but that could be part of the issue. I'm sure there are some abuses. TSS' issues with the State of Texas and CMS go back to 2005 when they were audited and found to owe 109 million dollars to CMS. TSS tried to settle with CMS for 22.5 million paid over a period of 5 years. During this time they continued to sell products and bill CMS for the equipment delivered by their offices in other states. Some say that TSS sold an average of 44,000 powered wheelchairs a year.
