The very first phrase in the statement is important.
"In the departments view"

This means that it is someones interpretation of the current 
legislation and whilst the route to that conclusion is perfectly 
logical, it is open to debate. It is unlikely (although not impossible) 
that you would be prosecuted. Even new cars with HID lights can be very 
bright in your mirror or coming towards you on a country lane, so for 
me it would be a risk worth taking as the pros outweigh the cons but as 
Matt says - It's your choice.
