To answer your potentially rhetorical question: anonymity. Most public malware 
is distributed via a chain of anonymous websites, so it is difficult to track 
the original creator. 

And even when law enforcement can find the starting point, it is a pseudonym at 
an Internet Cafe in a Baltic Republic where there aren't any cybercrime laws or 
extradition treaties. :-(
