Any mail that is reported by enough people is spam. :-)

This works quite nicely.  For example, the recent Sobig virus had a
habit of failing to attach payload to messages.  These messages would
slip through virus scanners.

A number of people reported these messages as spam, and voila!  No more
payload-free Sobig messages getting through. :-)
