The only radios with usage restrictions you are likely to find are 72Mhz which is for aircraft only and 75Mhz which is surface only. All other radios, can be used for air & surface. You will find a lot, if not all 2.4Ghz are labelled for air use they can still be used for surface as well.
That is how it is in North America.
