CellStr=History.Cell(row, 3)

I am unsure why this is the case as the listbox should have five
columns and think that the CellBackgroundPaint event should only
return the row values for rows that exists.

Any ideas?  I am currently testing on Windows XP.

In 2006, you have to use
if row <= me.listcount - 1

not sure why...
I just moved a large project over from 5.5 and had the same issue.
