kick backs to make money??? ARE YOU HIRING AN EMPLOYEE FOR A LONG TERM
REALTIONSHIP, ie TRAING THAT PERSON IN THE MORTGAGE BUSINESS, or just paying
kick backs due to lack of a marketing budget or new in the
business?

You are not correct. Each rule is specific to its situs.
There are few blanket rules. Usually legality is determined by
disclosure.
