"I refer to Robert Mannes' article (Herald, May 3) regarding the "separated
children" [I believe the term used was 'stolen' - T] test case in Darwin in
relation to which an interim judgement was delivered by the Federal Court on
April 30.
In accordance with the practice of this and previous arguements [sic], I did not
intend to comment on matters before the courts. I therefore refrain from
commenting on Mr Manne's portrayal of the Commonwealth's conduct of the current
case.
I must say, however, that the Commonwealth is not seeking to justify the events
of the past otherwise than to say that they were within the law. At the same
time it does not accept that the child removal policies were deliberately
designed for the destruction of a race of people, but were implemented at a time
when the policies were considered to be in the best interests of the children.
I would point out that this litigation started before the release of the HREOC
Separated Children Report, and did not therefore proceed as a consequence of the
Government's response to the report.
The Keating Labor Government also defended related litigation. Additionally the
New South Wales Government of Premier Bob Carr is defending similar litigation
to that being defended by the Commonwealth in the Cubillo and Gunner matters."
