Friends,
The only way that Aboriginal Peoples could be affected by the proposed
constitutional amendments is if access to that residual British legislation,
such as George 3 original proclamation, or the law mandating the Australian
Constitution and any provisions contained therein, if there are any, were to
be removed.
My understanding is that nothing, in our relationship with this body of law
actually changes, just as our relationship with British Common Law would not
change. Even the U.S. jurisprudence is subject to the British Common Law in
train up to the Declaration if Independence. I expect we would be included
under a similar Convention.
The only changes envisaged in this referendum are replacement of the names,
Queen and the Governor General, with the title President, and a change to
the method of election of that President. I do believe that Aden Ridgeway
would have less chance of being elected President than as Governor General,
purely because he is a politician. Peter Yu would at least be able to get
his name up for President; he has no hope of being appointed Governor
General.
