ABC News Fri, 5 May 2000 16:12 CST LOCAL NEWS : Northern Territory Judge rules case against Chief Magistrate can proceed A Northern Territory Supreme Court judge has struck out action aimed at prohibiting the Chief Magistrate Hugh Bradley from hearing a range of cases, including those involving juveniles. Justice Howard Olney ruled it would not be a proper exercise of the court's power to grant an order prohibiting action that is prospective, or in the future. Justice Olney has, however, ruled that the Aboriginal legal service's application to have Mr Bradley's appointment as the Chief Magistrate declared invalid, can go ahead. He said the matter of judicial immunity was not applicable. He has given the service until May 12 to prepare and lodge a proper statement of claim. 1999 Australian Broadcasting Corporation -- _________________________________ Truth is a pathless land. --- Krishnamurti ------------------------------------------------- ------------------------------------------------------ RecOzNet2 has a page @ http://www.green.net.au/recoznet2 and is archived at http://www.mail-archive.com/ To unsubscribe from this list, mail [EMAIL PROTECTED], and in the body of the message, include the words: unsubscribe announce or click here mailto:[EMAIL PROTECTED]?Body=unsubscribe%20announce This posting is provided to the individual members of this group without permission from the copyright owner for purposes of criticism, comment, scholarship and research under the "fair use" provisions of the Federal copyright laws and it may not be distributed further without permission of the copyright owner, except for "fair use."
