ABC News Fri, 4 Aug 2000 15:32 AEST INDIGENOUS NEWS High Court agrees to hear Aboriginal welfare case appeal A group of Aboriginal people from Western Australia have been given the go-ahead to take a case to the High Court, arguing millions of dollars should have been set aside for the welfare of Aborigines. The case centres on a section of Western Australia's constitution of 1889 which states 5,000 pounds, or 1 per cent of consolidated revenue, should be paid to Her Majesty the Queen each year for the welfare of Aborigines. Over a period of a hundred years, several acts of Parliament have been passed to repeal that section but lawyers for the plaintiffs, a group of elders from the Pilbara allege it was never properly repealed. The full court of the Federal Court found the section had been effectively invalidated and the applicants had no standing to bring the case.
