Chip-- I never said that the Catholic Church had experienced such litigation; we were talking about hypotheticals. 
 
Is the absence of Catholic Church gender litigation because these cases have never been brought, or because the claim is not cognizable under the ministerial exception?     With respect to Bollard and Elvig, they are not simply exceptions to the general rule, but are part of the evolving law being applied to religious entity's employment practices and point the way to the future.
