The Huntsville City Council on Thursday night approved a settlement in a
2-year-old federal lawsuit that challenged the city's enforcement of historic
preservation regulations.

Temple B'Nai Sholom, a synagogue in the Twickenham Historic Preservation
District, has argued the city's Historic Preservation Commission violated the
temple's First Amendment right of freedom of religion by denying it permission to
demolish an old house on temple property to make room for an expansion.

Experts said the temple's lawsuit could have been a major test case of the
federal Religious Land Use Act, which protects a religious institution's use of
its property for worship purposes.
