You're right... There is no expectation of privacy over normal radio
communications (except cellular of course), so there isn't anything wrong
with recording it.

Not much, but it has a lot to do with mis-information.
The first few posts were all talking about why Riley
would want someone to tape a radio conversation, which
would be against federal law.

On futher research, it would seem that it would be OK
to tape (and divulge) transmissions coming over
regular radio channels, such as ham, CB, MURS, LMR,
marine, etc. The federal court apparently interprets
things that way.
