You're right... There is no expectation of privacy over normal radio communications (except cellular of course), so there isn't anything wrong with recording it.

On futher research, it would seem that it would be OK to tape (and divulge) transmissions coming over regular radio channels, such as ham, CB, MURS, LMR, marine, etc. The federal court apparently interprets things that way.
