Sen Brown (R-MA) was elected before the House voted and the Senate lost it’s filibuster-proof majority. If the House bill was passed, it must go to Reconcilliation, to have the “how to” regulations written in. It would then risk a filibuster in the Senate and never reach the desk of the POTUS. The bill managers decided to dump the House version (HR3200), and instead have the House vote to accept the Senate bill as is. HR 3590 (*2) The House passed HR 3590, identical to the Senate bill, and the POTUS signed it into law---without the “how to” regulations ever being written. After it was apssed, the executive Dept took it upon themselves to write the “how to” legislation not included by Congress. (*3) Without those regulations, the bill signed by the POTUS would amount to a proposal, not a law that could be followed or eiforced. *(1) All legislative powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives. Article I, Section I *(2) All bills for raising revenue shall originate in the House of Representatives; but the Senate may propose or concur with amendments as on other bills. Article I, Section 7, Clause 1 *(3) See *(1) above. Hence, the Socialized Medicine law is patently unConstitutional, however there is one problem. According to SCOTUS recent history, no one in America has standing to challenge it in court. Next question, why didn’t the states cases Vs the USG go directly to the SCOTUS for judication? In all cases affecting ambassadors, other public ministers and consuls, and those in which a state shall be a party, the supreme court shall have original jurisdiction. In all the other cases before-mentioned, the supreme court shall have appellate jurisdiction, both as to law and fact, with such exceptions, and under such regulations as the Congress shall make.
