Overturning a SCOTUS mistake is not easy, short of an Article V Convention. Rich Martin The Congress, whenever two-thirds of both houses shall deem it necessary, shall propose amendments to this constitution, or on the application of the legislatures of two-thirdsof the several states, shall call a convention for proposing amendments, which, in either case, shall be valid to all intents and purposes, as part of this constitution, when ratified by the legislatures of three-fourthsof the several states, or by conventions in three-fourthsthereof, as the one or the other mode of ratification may be proposed by the Congress: Provided, that no amendment which may be made prior to the year 1808, shall in any manner affect the first and fourth clauses in the ninth section of the first article; and that no state, without its consent, shall be deprived of its equal suffrage in the Senate. IMHO, this is sthe preferred way AFTER the election, regadless of the election results. In my dreams, immediately after the GOP wins the election, the House should charge the POTUS of usurping unConstitutional authority and in violation of Article II, Section 1. Clause 4. An impeachment hearing should convene in December and the indictment should sport a list the particulars, such as declaring war on his own, closing the Gulf deep drilling, etc. The vote on impeachment should co-incide with the seating of the new Senate early Jan. 2013. The Senate trial must start immediately and end with a conviction including usurption under Art II, Sec 1. Clause 4. Why this way, and not just let the POTUS ride off in the sunset a defeated man? The harm that’s been done to our country in the last 4 years will take decades to fully recover from. Expultion of the POTUS would render every decision he made, every document he ever signe as President while in Office, immediately null and void. Tax rates would return to the level they were when he took office, Every one he appointed from his cabinet to the White House kitchen (including his 2 Supreme Court selections, his 40+ czars, innumeral bureaucrats and even the bundler ambassadors around the globe), cuts in military retored, would be gone. Oh, yeah, incidentally, Obamacare and all its new regs and taxes, gone. Certainly the new Congress and President would have their hands full, but it is reasonable that with co-operation with the of the Article V convention, the recovery would start sooner and end considerably sooner. But before all this, step 1. Fire the president and as many of his Congressional cohorts as possible Nov 6. Note: The President has no role in a Article V Convention and the Senate cannot filibuster.
