Biofuels 1. Boy Scouts. It appears that the Boy Scouts of America (BSA) is on the verge of dropping its ban on homosexual members and scout leaders. The organization has been under significant pressure from corporate sponsors, politicians, and the gay rights movement prosecuting lawfare against the BSA. Sounds like BSA national is going to shove the decision making authority for allowing homosexuals into individual troops to the local organizations; sort of a federalism approach. While I strongly disagree with the overall decision, allowing local organizations to make their decision on this may be the best way to go. But you can’t do this too many times or the overall structure and foundation of scouting will dissolve in front of our very eyes and do so pretty quickly. The other thing that they need to figure out how to do is protect the regional and national organizations from lawfare lawsuits brought by parents and boys that have been molested by homosexuals while members of the Boy Scouts. The left is playing a real cute game here. On the one hand, they demand that the Boy Scouts be completely open to homosexuals. On the other hand, they hold it completely responsible for homosexuals who should not be members or leaders doing what homosexuals do to one another. I don’t think this is going to solve much. But it does mark another milestone on the road as the culture changes in front of our eyes. 2. Handicap Sports. Obama’s Department of Education decided to take another hatchet to public education. This time around, decreeing that public schools that receive federal money should make reasonable accommodations for handicapped students to participate in their sports programs. Of course, the definition of reasonable is completely up to the leftists infesting the Obama administration, their supporters among the trial lawyers, and the courts that will get to adjudicate the expected tsunami of lawsuits. This is little more than another vehicle to take care of the democrat supporting trial lawyers. The last time the feds took a stab at sports was via Title IX, which mandated equal access to sports for men and women. At the time it was passed, college level men’s sports were widespread and vibrant. Women’s sports were just beginning. The end result has been the decimation of gymnastics, swimming, tennis, and lower level sports for men, as they were widely shut down in order to protect the money making sports like football and basketball and make the Title IX numbers work. Women have paid their price in this also, being introduced to blown out knees at an astounding rate. The ladies are not built like men, and do not have the musculature necessary to protect their joints. Now the feds propose to do the same thing with handicappers, which already have a sports program available with the Special Olympics. The problem is even worse for public schools, as there are not all that many handicappers to begin with and they vary widely with their abilities. These people whose bodies who do not like them a lot will be used as tools by the “well meaning” left to attack existing sports, and will in turn get them despised by those losing their high school sports teams. This can’t end well. As usual, the road to Hell continues to be paved with good intentions, though I don’t think the intentions from the Obamaoids on this are all that good. 3. Raisins. Did anyone else out there know that raisin farmers were required to give 47% of their crop to the feds without compensation so the feds can use the tribute to control prices? This particular intrusion into the marketplace came via the New Deal and started under FDR in 1937. A raisin company started fighting back in 2002 by refusing to set aside the tribute to the feds. The feds took them to court and the entire mess has been slowly working its way through the courts for the last decade. Last week, the SCOTUS agreed to hear the case. The growers look at this rightfully as a regulatory taking of their property without just compensation. The feds argue that the raisin growers “identify no reason why the imposition of a civil penalty and other assessments for noncompliance with a regulatory scheme constitutes a taking of property without just compensation.” The Ninth Circus went on to note that the program (legalized theft) has long been an important part of the industry in California, demonstrating once again why the Ninth Circus needs to be dissolved by congress at its earliest opportunity. 4. Birds. The Obama administration has used Eric Holder’s (In)Justice Department as a vehicle to harass and destroy the fossil fuel industry. This time is selective enforcement of federal laws protecting migratory birds from being killed. What they do is prosecute to the fullest extent of the law any and all bird deaths around oil wells, mines, pumping stations, refineries, and industrial areas. And the bird watchers are out on site, busily reporting every single tragic event. On the other hand, they show no interest in pursuing the same sort of justice (and vigorish) from the real operators of bird blenders – the wind energy industry. Indeed, nationwide, the wind energy industry is pursuing pursing permits that allow them to kill eagles, falcons and vultures every year. Menendez. Robert Menendez (D, NJ) appears to be in a spot of trouble, and it is serious enough that the state controlled media is starting to run stories about it. Menendez is single and apparently enjoys the ladies – very young working ladies. He also does the standard democrat take care of your contributors with legislative favors routine. Last week, the FBI raided the office of a Doctor with close ties to Menendez after someone saw a shredding truck in the area. Menendez quickly rushed to compensate the doctor for a free ride in a private jet to the Dominican Republic where he visited some working girls. There is a photo of one making its rounds of the internet. If this is as serious as it sounds, Menendez may very well not survive. Unfortunately as I understand NJ rules on filling congressional vacancies, it appears that Governor Christy’s role in a possible replacement would only be in calling a special election. Historically in NJ, the seats have remained open until the next general election mostly due to the cost of holding a statewide election. Note also that Menendez is Harry Reid’s point man on immigration, as the democrat majority tries to lock in their electoral advantage by legalizing between 11 – 20 million new voters. 6. Biofuels. The definition of insanity is doing the same thing over and over while expecting a different result. By this definition, the EPA is certifiably insane. Latest example is their biofuel mandate. Last Friday, the DC Circuit Court of Appeals found that the EPA may not punish oil companies and refineries for failing to comply with their Renewable Fuels Standards. These standards mandate a certain amount of cellulose based biofuels be mixed in with their product. The problem with this mandate is that the biofuels simply do not exist in the quantities mandated by the EPA. For example, the EPA mandated 5 million gallons, 6.6 million gallons and 8.7 million gallons of cellulose based biofuels to be used in 2010, 2011 and 2012 respectively. The problem is that none was available in 2010 or 2011, and only 20,069 gallons – not million gallons – were available in 2012. The Court found that it was impossible to comply with a mandate if the product simply does not exist and barred the EPA from fining the refineries for failure to comply. In response, the EPA, ever sensible, announced that the 2013 mandate would be 14 million gallons. And it is our tax dollars paying these idiots. The EPA is completely out of control and has gone feral. Time to defund it and shut it down completely, transferring the power to the many states.
