My advice is to use "encoding system" in your code, and act accordingly in the code (use or not use encoding convertfrom). This way, the code will work even in cases you cannot control the settings apache runs with.

well, this explains everything, the command on the system stock apache instance (the failing one) returns iso8859-1 while the other returns utf-8. I had been mislead by the locale of the user running Apache

but looking harder in the configuration I found

which changed what I assumed was the default
