While game play is similar it is far from the same (and in fact some key features of the 'original' game play are not there), the code has not been copied, but is self-written without access to the Bejeweled game source code. Graphics are again similar, but not the same by far. I do not hink his claim would stand a chance if he choose to pursue it. At least he'd have to prove that anything was copied from the original (besides the basic idea, which is obvious but afaik not illegal in any way)..
