I may be missing something obvious, but I don't understand the problem. Themes are just data used by Rockbox, in the same way as fonts are, and even audio files. How are they "part of the code", and hence required to be GPL'd ?

Another issue that seems a bit weird is that themes derived from Cabbiev2
can't be uploaded to the theme site. As I see it, we have 4 options:

Yes, it would make sense for Cabbiev2 to be under CC-BY-SA. I guess the svn logs would tell us who we need to get agreement from...
