Daca nu ma insel, finalizarea pachetului este inca departe. Pe 4 noiembrie de-abia urmeaza ca Parlamentul European si Consiliul sa inceapa medierea pe acest subiect pentru a ajunge la un consens. Si nu, nu Parlamentul European a finalizat legislatia in aceasta forma. Dimpotriva. PE a introdus un amendament, adoptat cu larga majoritate, care spune ca accesul la internet este un drept fundamental si ca atare poate fi restrictionat numai DUPA ce cazul a fost in prealabil judecat iar instanta a hotarat in consecinta. Amendamentul PE a fost respins de Consiliu (de unde si necesitatea procesului de mediere): "the requirement of a prior judicial ruling means that this legislation, based on Article 95 of the Treaty (Internal Market), would be harmonising the constitutional and judicial frameworks of Member States which is something that goes beyond Community competences and that, as a result, would be rejected by the European Court of Justice in the case of an appeal." PE a anuntat ca nu renunta la introducerea unei prevederi care sa maximizeze protectia drepturilor utilizatorilor si ca, desi merge la mediere deschis spre gasirea unei solutii de compromis, doreste sa se asigure ca orice masuri vor fi luate pentru restrictionarea accesului la internet, acestea vor fi rezultatul unui proces prealabil, drept si impartial care sa asigure dreptul de a fi ascultat si sa respecte principiul prezumtiei de nevinovatie asa cum a fost stabilit de Conventia Europeana pentru Protectia Drepturilor Omului si Libertatilor Fundamentale. In acest fel, PE doreste sa evite abuzurile si sa se asigure ca autoritatile nu vor lua hotarari arbitrare care sa incalce drepturile utilizatorilor de internet. Presedintele Delegatiei PE, Alejo Vidal-Quadras: "It would be a shame not to reach an agreement with Council as it would throw away all the hard work Parliament has put into it for over two years and where a lot of significant advances have been achieved. We go to negotiations with a compromising spirit but firm in our defence of the rights of the users and committed in the development of a regulatory framework that would incentivise investments and that would open the market.
