unfortunantly, you are unlikely to be able to fix the issue without upgrading (I
haven't heard other reports with newer versions).
but you may want to check how the files are being created. Some people have
their log rotation scripts create empty files, and if they are created by
something outside of rsyslog, when rsyslog starts to write to them, it won't be
creating the file, and so the group/owner/permission stuff won't be applied
