I had the same problem when I did a "direct upgrade" from 3.6.x to 3.8.1
...
It worked for me this way:
- upgrade to 3.8.0
- applying the mysql-4.0-41 update
- upgrade from 3.8.0 to 3.8.1 ...

Now the attachements are corrupted.. any fix for this?
