NCAA asks court to deny records to Young By Christopher Walsh Staff writer May 28, 2004 The National Collegiate Athletic Association has filed a motion with the U.S. District Court of Western Tennessee to quash Logan Young's request for NCAA records related to the investigation into the University of Alabama football program that eventually resulted in penalties and sanctions. In addition, attorneys for Tennessee coach Phillip Fulmer filed for certification regarding materials requested by defense counsel, claiming that they are not available. Among them are tapes of conversations between Fulmer and recruiting analyst Tom Culpepper. The existence of the tapes became public knowledge in January through the federal criminal case in Memphis. Young's attorneys are expected to quickly respond to both requests. On Tuesday, Judge Daniel Breen of the U.S. District Court for Western Tennessee did not address a motion for dismissal. The next report date in the Young proceedings is set for July 26. Perhaps ironically, Young's attorney Jim Neal is an expert on tape recordings and evidence. He was the chief counsel to the Watergate Special Prosecution Force. Neal was also the first attorney to obtain a conviction of Jimmy Hoffa, and was chief counsel to a special U.S. Senate committee that investigated the Abscam bribery case involving congressmen. "If Phil can't find the tapes, I feel sorry for Phil," said Tommy Gallion, the lead attorney for former Alabama assistant coach Ronnie Cottrell and Ivy Williams in their $60 million lawsuit against the NCAA. Gallion said that former SEC Commissioner Roy Kramer has agreed to give a deposition in his case. Kramer was commissioner when Alabama was investigated, but not named as a defendant. University officials Gene Marsh and Marie Robbins have already been dropped from the suit, given depositions and are expected to testify should the case go to trial.
