Young unlikely to see jail time
2005-06-21
by Haywood Harris

A widely-respected Knoxville attorney who keeps close tab on how the law
interacts with sports suggests you not hold your breath while waiting for Logan
Young to serve his six-months jail sentence for buying a football player.

Young, a wealthy Alabama booster from Memphis, was found guilty of bribing a
public official to guide Albert Means to Tuscaloosa for furtherance of his
college education. Young was convicted of giving Lynn Lang, Means' high school
coach, a $150,000 payoff to get him into a Crimson Tide uniform.

The lawyer, who asked that his name not be used in this story, thinks Young
will walk scot-free when a court of appeals takes a close look at the
circumstances that led to bribery charges.

``There are two points of law the conviction ignored that likely will overturn
the conviction,'' the barrister pointed out. ``First a coach is generally not
regarded as a public official in legal terms. Normally the term applies to
elected office-holders.''

The other disqualifying factor, the lawyer says, is that Lynn was not operating
within the scope of his official duties as a coach when he steered Means to
Alabama. There is nothing in the description of a coach's responsibilities that
suggests he should become involved in recruiting warfare.

``He'll get out of it, I feel sure,'' the attorney added. ``There is a world of
difference, technically at least, between violating NCAA rules and breaking the
law.''
