I have received a message from Mr.Babubhai Vaghela which I must share
with the group. This is an exclusive mail which was sent to me and a
few other worthies like Madam President, Vice President, all the
Information Commissioners etc. and I am very glad to be honored in
such august company.

Mr. Babubhai has received certain observations from one Mr. Mohd.
Haleem Khan - he is the new Secy. of CIC. Although Mr. Khan could not
reply properly to Sh.Vaghela I am sure that members of this group are
up to the task - which is a trivial problem. I was shocked that
Mr.Vaghela is upset (and has no faith) with Prof Ansari (someone I
have very recently described on Sackhim as the sole saving grace /
asset of CIC) in some previous matter. I took the pains to track down
the said order of Prof M.M.Ansari. Really Mr.Vaghela you have been a
naughty boy and have misused RTI like anything - 135 RTIs against
IOC(???). With appellants, applicants like you we can see why Prof
Ansari has such a good batting average. Running away from CIC to G-SIC
is not the answer, if you are sure of yourself and your cause face
Prof Ansari again and beat him at his own game - we are all here to
help you Brother..

Dear Sir,

Mr. L C Singhi, Additional Registrar, CIC, New Delhi, vide F. No.
CIC/MA/A/2008/00088 dated 28/01/2008 informed me that the hearing of
the subject mentioned RTI second  appeal was fixed for hearing by Prof
M M Ansari, IC, CIC, on 4th April 2008.

In this regard, I wish to reiterate that, time and again, I have
categorically and specifically conveyed that I do not have any faith
in the integrity and impartiality of Prof M M Ansari, IC, CIC; he has
not done justice to me in the past and I have no faith in him in
giving me the justice (for the reasons already recorded a no. of
times). However, hearing of my second appeal by him and not by any
other IC of CIC or by full bench of CIC has fixed.

Further, this is not the second appeal that I have submitted myself to
CIC New Delhi but has been unilaterally transferred by Gujarat
Information Commission, Gandhinagar to CIC New Delhi on the ground
that it falls within the jurisdiction of CIC.

Complete details of my RTI application, PIO's reply and FAA's
disposal, all these papers submitted to GIC Gandhinagar have been sent
by GIC to CIC. Soft copies  enclosed herewith. Neither Gujarat
Information Commission nor Central Information Commission nor Mr S K
Sarangi, PIO Indian Oil nor Mr A K Rauniar, FAA Indian Oil has
furnished me a copy of the reply submitted by them to GIC/CIC  for the
RTI appellant to submit rejoinder and without it this hearing on 4th
April 2008 has been fixed.

Further, Shri Mohd Haleem Khan, Secretary, Central Information
Commission, New Delhi, in response to my RTI application to CPIO CIC
New Delhi dated 5th February 2008, vide his letter no.
CIC/CPIO/2008/307 dated 18th March 2008 has informed me that CIC has
no information on:

1.    Section no. of the Right to Information Act 2005 that permits
transfer of second appeal or complaint from State Information
Commission to Central Information Commission and vice-a-versa.

2.    Section no. of the Right to Information Act 2005 that permits
acceptance of second appeal or complaint by CIC from any State
Information Commission.

3.    Section no. of the Right to Information Act 2005 that permits
acceptance of second appeal or complaint by CIC from anyone else other
than the RTI appellant.

4.    Section no. of the Right to Information Act 2005 that
specifically prohibits State Information Commission from hearing the
RTI second appeal or complaint pertaining to the Central Govt. PSU.

In nutshell, CIC does not know whether the second appeal in question
falls within the jurisdiction of CIC or not.

Moreover, Shri Mohd Haleem Khan has reiterated that the second appeal
would be heard by Prof M M Anasari,IC, CIC, New Delhi on 4th April 2008.

In the light of the above, I would like to know as to why should Prof
M M Ansari, IC, CIC, New Delhi proceed with the hearing of the second
appeal on 4th April 2008 when the Central Information Commission does
not know whether this second appeal falls within the jurisdiction of
CIC or not.

I shall be grateful for timely response for further needful at my end.
