The action by U.P. Governor of suspending the state Chief Information
Commissioner retired Justice M.A. Khan and preventing him from going to work is
justified because:

 (1) He had failed in the implementation of RTI Act, 2005 according to its
provisions.

(2) He had failed in the implementation of Appeal Procedures Rule as part of
this Act.

(3) He did not use to give speaking orders.

(4) He used to give biased orders. He was harsh on appellants and soft
towards the PIOs.

(5) He refused to provide information related to the Commission under the RTI
Act, 2005.

(6) He had failed to realize the penalties imposed on PIOs in most of the
cases of delays in providing information.
