Dear Mr Brandoconscience; 1) The replies from CPIO indicate that your representations to take cognisance of your allegations were addressed to the officers concerned, and hence do not form part of the official records of the Public Authority. Since the documents requested do not comprise records, neither the PIO nor the PA are obliged in law to provide them to you.
2) Question of PA summoning them from ex-official is not indicated in your case. 3) Your remedies:- a) File Complaint u/s 18 to CIC, stating that PA has malafidely destroyed / rendered untraceable the specific information sought by you, praying that the documents may be summoned.from the ex-official to examine notings / action taken. As yours is a frivolous complaint, you shall have to influence / bribe the I.C. concerned to issue such summons via his personal staff. b) File a complaint to Central Vigilance Commission, using the reply of CPIO as cause of action.
