Subject : Request to correct the orders
Dear Sir,
Refer to your order dated 29-12-08 in the above said matter, this is to inform
you that many agreed points have not been included in your order which was
uploaded on your website on 21-Jan-08.
You are requested to please recall the detailed discussion, wherein you have
agreed and noted the following;
1. Hundreds of replies received from SPIOs of the entire state of Punjab
were handed-over to you and ongoing mockery of RTI act was highlighted and you
have agreed to issue necessary direction to Chief Secretary, Punjab and a
compliance report to be sought from him because;
a. none of SPIO has replied within 30 days
b. none of SPIO has provide their full contact details
c. none of the SPIO has provided the address of Appellate authority
d. many SPIO have provided wrong information
2. Order the PIO O/o CMO, Punjab to collect and supply the “action Taken”
Report on various letters/e-mails as per point 6 of the RTI application
However, these important points have not been refelected/indicated anywhere in
your orders.
You would appreciate the fact that “hundreds’ of SPIO have been found not
following the RTI act and this kind of evidences/cases may not repeat in future.
So, you are requested to take cognizance of the matter and correct your orders
as promised during the discussion in your chamber.

ORDER
1. Heard both the parties.
2. The information relating to Punjab Vidhan Sabha is
submitted to the Commission, which is taken on record. One copy each of the
same is handed over to Appellant and the PIO of the office of Chief
Secretary Punjab, in the court today in my presence. After the detailed
deliberations held in the court today, Shri Amar Singh, Superintendent,
General Coordination, office of Chief Secretary Punjab, states that the
information required by the Appellant relates to

the Home Department and may, therefore, be obtained from the Home Department
. He further states that the PIO of the Home Department may be asked to attend
the proceedings in the instant case in future and supply the information
regarding instructions issued by the Home Department from time to time
regarding Resolution of the Punjab Vidhan Sabha dated 21st June, 2007
containing the recommendations to the State Government to instruct the Police
Department to get the increasing dowry related cases registered by the parents
of the newly wedded brides thoroughly investigated.
3. It is accordingly directed that the PIO/Representative
of the Home Department will attend the proceedings along with
information/documents on the next date of hearing, regarding recommendations
of the Punjab Vidhan Sabha on 21st June, 2007 through a Resolution of Master
Mohan Lal, Cabinet Minister. Shri Amar Singh, Superintendent General
Coordination is directed to send a copy of the appeal dated 1.4.2008 of Shri
Bhushan Kumar, Appellant, to the PIO of the Home Department asking him to
send the requisite information, demanded by the Appellant. to the Chief
Secretary so that the same could further be supplied to the Appellant.
4. The PIO of the office of Chief Minister, Punjab , states
that the Appellant may be directed to supply hard copy of the
letters/memorandums sent to the CMO Punjab or Chief Secretary Punjab regarding
abuse/mis-use of IPC

498A, 406, D.P. Act, DB Act by women. He assures the Commission that about 25
hard copies of the letters/memorandums sent to the CMO and Chief Secretary
Punjab will be supplied to the PIO of the office of Chief Minister, Punjab with
one copy to the Commission. The representatives of CMO and C.S. state that it
is not in their knowledge whether any other NGO has sent any
complaint/memorandum to the office of Chief Minister, Punjab or Chief Secretary
Punjab on this subject.
5. The Appellant states that he may be compensated under
Section 19(8)(b) of the RTI Act, 2005, for the detriment suffered by him. The
decision to give compensation will be taken on the next date of hearing after
due arguments.
6. The case is fixed for further hearing on 27.2.2009 in
the Chamber(SCO No. 32-33-34, Sector: 17-C, Chandigarh ).
7. Copies of the order be sent to both the parties.
