Subject : PIO O/o Punjab State Information Commission,
Chandigarh is NOT obeying Punjab State
Information Commission's orders
A classic case of mockery of RTI Act
Sir,
1. That above noted case is pending before the Hon'ble Court and fixed
for 02-June-09
2. That it is submitted that so far PIO has not supplied even single
page information despite the clear orders of Hon'ble court on 13-March-09 to
supply the identified information within 15days. What could be more shameful
for the Hon'ble Court , when their own PIO are not honoring their orders?
3. That very first application was rejected by the PIO O/o State
Commission on the pretext that "many man-hours will be used to compile the
information" whereas, if you recall the proceedings on 13-March-09, the PIO
could not locate more than 9 files out of total 16 files. So, it can easily
be construed that PIO has rejected the first application without even seeing
the quantum of papers need to be copied.
4. That during last proceedings PIO also stated that "e-mails" have not
been received whereas later from the files we have found that all the
e-mails are very much present in the files.
5. That act and conduct of the PIO is very clear.
6. That PIO has 'intentionally' refused to supply the information.
7. That despite all his efforts to mislead the Court, the Hon'ble Court
on 13-March-09 directed the PIO to supply the identified documents from the
Nine files shown to the appellant with 15 days and send the remaining
information within One Month.
8. That PIO has neither supplied the copies of the identified papers
from nine cases not provided any other information.
9. That nothing has been supplied by the PIO as of date.
10. That this is a classic case of mockery of RTI act.
11. That PIO is intentionally harassing the appellant and delaying the
matter and is liable for punishment as per RTI act 2005.
12. That departmental inquiry may please be ordered against the PIO for
purposefully refusing to supply the information.
13. That please recall our discussions on the mockery of RTI act Punjab
fueled by leniency shown by Information Commissioners by not imposing the
penalty. Also I have submitted the replies of around 100 PIOs who have
neither replied in time nor gave any details of Appellate authority.
14. That the purpose of creating the State Information commission stands
defeated as far as state of Punjab is concerned.
15. That Information Commissioners must take the moral responsibility for
this poorly implemented RTI act in the state of Punjab .
16. That appellant may please be compensated for the undue harassment in the
hands of state commission.
