Respected Sir, 
 
SUB ::  DERELICTION OF DUTY AND OFFICIAL FAVOUR
            BY  H.N. KRISHNA, INFORMATION COMMISSIONER.
 
 
I  am herewith  submitting a copy of order passed by H.N. Krishna, Information 
Commissioner in Complaint  No.  KIC:611:COM:2009 dated 26.5.2009.  
 
I had submitted an application under RTI  before  The Asst. Executive Engineer, 
BBMP, Mahadevapura Sub Division seeking certain information.  As there was no 
response a complaint was filed before the Karnataka Information Commission on 
20.1.2009.  A notice was issued to the  Respondent (AEE  Mahadevapura) on 
7.3.2009 directing him to appear before the commission on 26.5.2009.  
Accordingly the case was heard by H N Krishna on 26.5.2009 and he disposed off 
the case without initiating any action against the Respondent  including levy 
of penalty as envisaged under various provisions of RTI Act.  H N Krishna 
disposed off the complaint with a direction to the Respondent to provide the 
information within a period of one Week.
 
It clear shows that H N Krishna has shown official favour to the Respondent by 
disposing off the complaint without any enquiry and without calling for the 
explanation from the Respondent.   No complaint can be closed unless full 
information is provided by the Respondents.  Thus H N Krishna is liable to be 
suspended from his post till completion of an enquiry for dereliction of duty 
to  be initiated against him.  This is a clear case of abuse of power by him.  
Atleast he should have issued a show cause notice to the Respondent and 
adjourned the case for further hearing.  Closure of complaint without calling 
for any explanation for delay and for not providing information by the 
Respondent is in contrary to the practice practiced by other Information 
Commissioners in the Karnataka Information Commission.  This  clearly indicates 
existence of corruption in Karnataka Information Commission.
 
I therefore request you to immediately order for Suspension of H N Krishna for 
his lapses in disposing off the complaint without proper enquiry.  I also 
request you to order for an enquiry against H N Krishna by an appropriate 
authority and render justice to RTI applicants in the public interest.
