15 top IAS officers fail to file annual returns in 07 and 08. Prominent names 
include former PCMC chiefs Dilip Band and Aseem Kumar Gupta 
Fifteen officers of the Indian Administrative Service (IAS) are in a sticky 
situation. A Right to Information Act (RTI) query revealed the names of IAS 
officers who did not submit their annual returns (it includes movable and 
immovable property taxes) to the general administration department as on 
January 1, 2009. The RTI was filed by activist Vihar Durve. 
Among the fifteen are two wellknown faces Dilip Band, the divisional 
commissioner of Pune, also a former Pimpri Chinchwad municipal commissioner , 
and Aseem Kumar S K Gupta, also a former municipal commissioner of Pimpri 
Chinchwad . Every year, IAS officers are required to submit annual returns in 
the month of January as per the All India Service (Conduct) Rules 1968 (Rule 
16(1) and 16(2)) . Copies are required to be submitted in two sets, of which, 
one is to be submitted to the General Administration Department and the other 
is forwarded by the state government to Department of Personnel and Training 
(DoPT), said Durve. 
DoPT has issued circular number 11017/74/93-IAS (3), dated January 4, 1994 
about disciplinary proceedings which shall be taken against defaulting IAS 
officers. The government of Maharashtra has also issued circular numbers IAS - 
4504/ Pr K 71/ 2004 /9 dtd 26 May 2004 and IAS 1507/1342/ Pr K 234/07/09 dated 
October 31, 2007 that states that disciplinary proceedings will be taken 
against defaulting IAS officers. 
According to Article 311 of the Constitution of India , 311. a person of the 
civil services under a Union or State could be dismissed, removed or reduced in 
rank after the concerned person has been informed and an inquiry has been 
initiated and charges against him are proved. 
The RTI application was filed on April 6, 2009 in the general administration 
department of the state government, seeking the names and total number of IAS 
officers who have declared their returns, as well as those who havent filed 
their property declarations. 
The public information officer (PIO) didnt furnish the names of the officers 
who flouted the rules, so Durve filed a first appeal. Subsequently, on July 3, 
2009 the appellate authority directed the PIO to furnish the requested names 
but not the property declaration returns . 
Accordingly, PIO, R S Bhalekar furnished the information on July 16, 2009 in 
which the following information was revealed 
a) 9 defaulting IAS officers have not filed their returns for the year ending 
2007. 
b) 15 defaulting IAS officers have not filed their returns for the year ending 
2008. 
When this reporter contacted Aseem kumar S K Gupta, now in Nagpur , he replied, 
If the government asks for the submission of annual returns, I will submit them 
immediately. I havent filed my returns this year. But, as you have reminded me 
of it, I will do that. 
When this reporter spoke to Dilip Bund, he replied saying, I have submitted my 
returns to the government both last year and this year. I dont know how my name 
appears in the defaulters list. 
Further, Durve had also filed applications seeking the property declaration of 
Maharashtra IPS officers which was not furnished despite a period of thirty 
days lapsing. Also, the appellate authority DoPT (letter no F No 11/3/2009/EO/ 
PR( Part File) 18th June 2009) denied revealing details of the property 
declarations of central information commissioner Wajahat Habibullah, 
information commisioner A Tiwari and election commissioner Gopalswami and Navin 
Chawla, stating that this information is exempted under rule 8(i)( j) of the 
RTI Act, 2005.

liabilities with details of property inherited or acquired, on lease or 
mortgaged. It also includes shares, debentures, postal and bank deposits and 
cash
