Dear friends

        It is extremely disturbing to know that Banglore Police has regaistered 
a case against a person who had filed an RTI application. Charges framed under 
Sections 417, 418. 420, 427, 506, all deal with cases involving cheating, 
causing mischief involving monetary loss etc. It is  astonishing  as to how  
filing  of  RTI  application  can have ramification of cheating & monetary loss 
to an affected 3rd party. While we all should join to fight the high-handedness 
of  Police  in  registering  a  so-stated  frivolous  FIR,  we  would  like to  
know  correct details of  the  case  matter. Could  some one  who  is in  the  
know of things, share with us a copy of relative RTI
 Application and the related response from PIO, if available, which caused the 
problem and triggered a situation of FIR being lodged against the applicant. We 
would also like to know  about the person who lodged FIR with the Police Is he 
an individual citizen or an Official  from some Public  Authority who  felt 
aggrieved  or  threatened  with  RTI Application filed 
     
       I look to our Banglore friends for a quick response in the matter

We are sorry to know, that such a thing has happened to an RTI Activist. The 
IPC sections mentioned in the original emails are very much disturbing and are 
as follows;


Section 417. Punishment for cheating

Whoever cheats shall be punished with imprisonment of either description for a 
term which may extend to one year, or with fine. or with both
Section 418. Cheating with knowledge that wrongful loss may ensue to person 
whose interest offender is bound to protect

Whoever cheats with the knowledge that he is likely thereby to cause wrongful 
loss to a person whose interest in the transaction to which the cheating 
relates, he was found, either by law, or by a legal contract, to protect, shall 
be punished with imprisonment of either description for a term which may extend 
to three years, or with fine, or with both.

Section 420. Cheating and dishonestly inducing delivery of property

Whoever cheats and thereby dishonestly induces the person deceived any property 
to any person, or to make, alter or destroy the whole or any part of a valuable 
security, or anything which is signed or sealed, and which is capable of being 
converted into a valuable security, shall be punished with imprisonment of 
either description for a term which may extend to seven years, and shall also 
be liable to fine.

Section 427. Mischief causing damage to the amount of fifty rupees

Whoever commits mischief and thereby causes loss or damage to the amount of 
fifty rupees or upwards, shall be punished with imprisonment of either 
description for a term which may extend to two years, or with fine, or with 
both.


Section 506. Punishment for criminal intimidation

Whoever commits, the offence of criminal intimidation shall be punished with 
imprisonment of either description for a term which may extend to two years, or 
with fine, or with both;


If threat be to cause death or grievous hurt, etc.: -And if the threat be to 
cause death or grievous hurt, or to cause the destruction of any property by 
fire, or to cause an offence punishable with death or 1[imprisonment for life], 
or with imprisonment for a term which may extend to seven years, or to impute, 
unchastity to a woman, shall be punished with imprisonment of either 
description for a term which may extend to seven years, or with fine, or with 
both.

Whoever is Mr. S. Raghu, we suggest him to find a good advocate. If it is that 
difficult to find an advocate in this country, please let us know and we will 
find him a good advocate.

The Bangalore police has lost all sensitivity toward human

being and lost mental balance and are  behaving  berserk resulting

into a FIR against the RTI Activist.

It is admittedly a shameful act and violation of Human Rights and

rights granted in the Constitution of India, to the citizen of free

India.

        Urvashi,  has rightly brought this message to our knowledge we

all are to join together to  fight against the violation of

Humanrights and Mahamahim President is likeley to initiate action

against the erring policemen of Bangalore.

       When you are back to India from USA. I am sure, you would like

to take up the issue with the media
