I had applied for supply of some information under RTIA05 to CPIO, EPFC Delhi
South, Wazirpur, Delhi vide my application dated 24.12.08. CPIO, vide her
letter dated 22.01.09 referred it PIO & APFC in his office for reply. When no
reply was received from them, I sent my 1st appeal dated 27.03.09. When no
reply was received from 1st Appelate Authority, I submitted a complaint dated
08.04.09 to CIC, New Delhi. CIC, Sri M L Sharma, heard this matter on 21.07.09
when myself (the applicant) and the Respondant (CPIO) were present. CIC ordered
that the required information be supplied by CPIO within 4 weeks but did not
levy any penalty on CPIO for this lapse inspite of my request. Now, even the 4
weeks allowed by CIC are over but CPIO has not sent the required information
yet. Could somebody suggest what further action could be taken by me in this
matter.
Also, under what rule of RTIA05 can an office have a PIO under CPIO in an
office. Under RTIA05, an office can only have CAPIOs under CPIO for different
divisions/branches in a office. I had raised this question before CIC at the
time of hearing but he was of the view that CPIOs could as well have PIOs in
the offices.
