I was also a active worker of All India Kendriya Vidyalaya Teachers Association. It is only recognised Association in the department to represent the KV teachers in the Department In the year 2003, the higher authorities of KVS started some conspiracy against the AIKVTA to crush it. At present, they are successful in their mission. The Association is all most defunct now. In January 2007, I submitted 13 applications under Right to Information to the KVS HQ New Delhi related with the Association to unearth the conspiracy caused by the authority. They tried to escape from replying the letters. On Nov. 28, 2007 the Hon'ble Central Information Commission New Delhi instructed KVS strictly to provide proper information. From this date authorities planned to eliminate me from the department. They started their mission. They tried to harass me by several ways. Meanwhile, on April 22, 2008, the Hon'ble CIC announced its decision in my favour. The CIC asked KVS to pay me Rs. 5,000/- as compensation and provide information properly otherwise Commission will take strong action against the authorities in person. As, I was working in Kendriya Vidyalaya BNP Dewas (MP) under KVS Regional Office Bhopal (MP). On April 25, 2008, the RO Bhopal prepared a recommendation for Joint Commissioner (Administration) KVS HQ New Delhi to transfer me from Bhopal Region to any other Region on Administrative Ground. It is pertinent to note that the Regional Office Bhopal was only competent authority to transfer me on administrative ground as per clause 4 of KVS Transfer Guidelines. The then Assistant Commissioner KVS RO Bhapal handed over the above said recommendation letter personally to the JC (Admin) on April 30, 2008. She ordered for immediate action. On May 2, 2008 the concerned section submitted Note Sheet. All the concerned Officers signed the Note Sheet on same day. The Office was closed on May 3 & 4 due to Saturday and Sunday. On May 5, 2008 the KVS HQ New Delhi issued order to transfer me from KV Dewas (MP) to KV Kargil (Jammu-Kashmir). On very next day i.e. 6, May 2008 KV Dewas executed the order and relieved me from Dewas to Kargil. No time was given to me to make any representation against the transfer. On 21, May 2008 I sent a representation to the Commissioner KVS New Delhi to cancel the transfer made under mala fide and revenge full attitude. The Summer Vacation was started from May 4, 2008 and it had to go up to June 22, 2008. As per joining time rules, I had to join my duties up to July 7, 2008 (end of Summer Vacation June 22, 2008 + 15 day for joining time). No any direction was mentioned in Transfer Order or Relieving Order regarding the Kargil which is winter vacation place and I should not enjoy the summer vacation in connection with the joining time. On June 9, 2008, the AC Bhopal issued me a Show Cause notice with stating that I fail to join Kargil on or before May 21, 2008 as Joining Time rules. And I was also absent more than 15 day without sanctioned any leave. It shows that I lost my lien of service voluntarily. Why should I not be removed from service permanently? I replied the Show Cause Notice and mentioned that I was transferred by KVS HQ New Delhi. So I represented the transfer to KVS HQ and my representation was under consideration. Thus, at that time the serving of Show Cause Notice was not proper. The AC Bhopal informed me through its letter dated June 18,2008 that KVS had rejected my representation through its letter June 16, 2008. But the AC did not send the copy of the HQ letter. Then I demanded it. I got the said copy of the letter on July 7, 2008. The HQ letter contained only a sentence on my representation dated May 21, 2008 that my representation was considered but could not acceded to. The HQ did not issue a reasoning order. So I wrote again that I may please be communicated that what were the reasons under which my representation was rejected. No authority of KVS informed me the reasons till date. On 21, July 2008 the AC Bhopal issued an order for removal from service and it was made effective from May 7, 2008. I preferred an appeal to the Appellate Authority with mentioning that I had been removed from service without giving me a chance of personal hearing. And it is a violation of the article 311(2) of the Constitution of India. I was informed by the appellate authority that I was engaging myself in Satyagraha Andolan at that time. So giving the chance of personal hearing had no meaning. Then I appeal H.E. President of India. The Secretariat of the President issued an order to the Secretary Ministry of HRD New Delhi on Oct. 7, 2008 to take action in the matter and inform the appellant directly with the information to the President Secretariat. No action was taken on this letter till date. Meanwhile the Hon’ble Central Vigilance Commission also registered a case in my matter and appointed Sh. Sunil Kumar Joint Secretary Ministry of HRD to inquire the case and submit the report. I requested Sh. Sunil Kumar to give me a chance to present my case before him. I got no chance, in spite of that I sent all the relevant documents along with a detailed application to Sh. Sunil Kumar. But unfortunately without quoting a single word about the application submitted to Sh Sunil Kumar, the Vigilance Section of the Ministry submitted its report to the CVC with the recommendation that action of the KVS Officers was as per rule. So there is no reason to take any action in the matter and case may be closed. It was very surprisingly for me to know that the CVC closed the case on the said recommendation. I also requested the Secretary Ministry of HRD to permit me to be present in person to my side. No permission was given. I wrote my case to Hon’ble Sh. Kapil Sibbal also and requested for personal hearing. No action was taken. Then, I managed any how to meet him at his residence. On oct. 22, 2009 I met Hon’ble Sh. Sibbal and tried to explain my case. But unfortunately he was also not interested to listen me. Without listening me, he said “you should have join Kargil. You should have join Kargil.” Thus I did not find a single point where I could had explain my case. Then as a last option, I requested H.E. President of India to hear me on or before Nov. 30, 2009 (copy enclosed). Unfortunately no communication I received till date from any end on the letter to H.E. President of India also.
