In the US, that's not exactly true.  There's a one year period after
publication during which you can still file for patent protection on
the published items.

You can find the patent on various on-line servers, for example:
        http://patent.womplex.ibm.com/

It looks like the original filing was after publication but well
within the one year window.  (That would suggest, though, that this
will be a US-only patent.)
