Victor might correct me, but as far is i understood, as long
as you do a "free" (1) implementation, you will obtain
a license for "free" (2).

(1) From what Victor toled me some time ago, he will strongly
    follow the "open source way". His patent is only to defend
    his basic idea against similar patents that were intended
    for rt-extensions for i.e. WindowsNT.
    As far as i have understood it, any "free" license will be
    covered. IMHO, BSD should be "free" enough :-)

(2) "free", except taking the time for sending an email or
    somewhat like this :-)
    if it will be a fashion to do defensive patents 
    i the future, every project has to maintain
    a web-server that automaticaly sends licenses on
    requests concerning the key word "free" :-)
