of the kernel, and does *not* fall under the heading of "derived work".
Also note that the GPL below is copyrighted by the Free Software
Foundation, but the instance of code that it refers to (the Linux
kernel) is copyrighted by me and others who actually wrote it.

General practice indicates that this actually covers code running in kernel
space (modules) as well, and AFAIK, this has been confirmed by the copyright
holders of Linux. That is, the Linux license has an exception that makes it
more similar to the LGPL in this particular case. (Unfortunately, I can't find
the official statement right now...)
