Looks good, I'll have to try it out later. But if it doesn't work for you I really recommend using the rsync_with_remote_cache plugin. Install and usage details are here:
http://trac.extendviget.com/lab/wiki/CapistranoRsyncWithRemoteCache Even though this plugin still checks out a fresh copy from your repository, for some reason it doesn't trigger the error.
