Okay, achieved to solve it by defining a custom validation.

   def validate
     if newsletter.nil?
       errors.add(:newsletter, "Please specify 'yes' or 'no'")
     end
   end

I think boolean's are handled differently, did you try
validates_inclusion_of?.
