Sure --without any points you can easily write down a W. equation for the
Jacobian of the plane cubic. Even if the cubic has no rational points,
such as the famous {{{3x^3+4y^3+5z^3=0}}}. But that is not usual what
people want, and should have a different name (such as "Jacobian").
