Dear All, As you know, we have been struggling againstt the new domicile rule notified by the Govt. of Maharashtra where by birth / permanent resident and unotified rule of father and child both should have been taken birth in maharashtra - which are the criteria to become eligible for the higher education for engg / medicine / mba/ hotel management / architecture, from the current academic year. Our several representations right from Director of Technical Education, Maharashtra to the President of the Country yielded little result except a recommendation from a Cabinet Minister whom also we addressed our grievance.
We were constrained to approach Hon'ble High Court, Aurangabad bench praying for quashing the said unconstitutional and illegal rule. The Hon'ble Court had directed the Govt. to come with a solution or to file their reply before June, 2010. Now, it seems that, govt. is left with no other alternative than to cancel the said illegal domicile Rule. I have immense pleasure in informing you that the suitable notification revoking the said domicile rule is issued by the Govt. The said notification dated 24/5/2010 is attached for your reference. With this, no domicile certificate of any kind is required to be produced for the admission of higher education. I am sure, thousands of students and parents who were in trouble would now be relaxed and benefitted. I however wish to inform you that, as already informed, the govt. is planning to implement it from next year - this will have to be challenged it in due course of time at appropriate level because, although I will try to pray before High Court to restrain the govt. permanently from asking such domicile, in the legal sense when a grievance raised before a court is not in existence, the cause of action does not arise and thus the petition become "infractuous" and the court may dispose it off having seen that our grievance is solved. In that event, I am ready to extend whatever possible help so as to come out of the problem. Regards
