Young entrepreneur, BOB Ashley Delaney, moved the following resolution
at the Gram Sabha of Saligao village held on Sunday, 18 January, 2009,
and it was passed unopposed by applause:
"6. The Government should amend the Town and Country Planning Act
1974to incorporate the 73rd and 74th Amendments to the Constitution.
The Government of Goa, in the Legislative Assembly session convened in
February, 2009, should move a Bill on the lines of the draft TCP Bill,
1998, to bring the TCP Act in consonance with the Constitution of
India as amended in 1992."

The Sarpanch of Saligao agreed to the Gram Sabha request for expansion
of the Village Comittee from the TEN member committee, including
himself, to a larger committee with TWO or more representatives from
each WARD plus the Ward Member/Panch from each of the 9 Wards of
Saligao.

Earlier, BOB Miguel Braganza, Joint Secretary of the Goa Bachao
Abhiyan, spoke in Konkani to explain the DRP 2021 specially in the
context of the Baseline Map, the RP 2001 Plan with Gazette changes and
Google images and requested the villagers to decide what was good for
the village. Each one would see how the RP 2021 would affect their
village, their neighbourhood and themselves. He aske the villagers to
choose from the Resolutions circulated by GBA, CCF, CPR, CSJP or any
other organisation and adopt those which are beneficial and relevant
to their village. Most of the resolutions are focussed on empowering
the people. He displayed copies of the TCP Act, 1974 and the draft TCP
Bill, 1998 [Model Act circulated by the Central Govt. incorporating
the 73rd and 74th amendments. [The Saligao CCF  and a village group
from Nigvaddo had already given notice to the Panchayat of their
desire to move the resolutions circulated by GOACAN and GBA and for
expanding the Village Committee under RP 2021].

Architect Dean D'Cruz, a voter of the village and member of the State
Expert Committee on RP 2021, explained how Parra Panchayat and
Communidade had agreed to make the hill slopes owned by the
Communidade into "Private Forests" in the RP 2021 to ensure the
ecological sustainability and water recharge for the village.

The expanded VILLAGE COMMITTEE will have the following members:

When some of the villagers wanted to know the details of the migrants,
the Sarpanch requested them to obtain the same from the Calangute
Police Station, on the outskirts of the village. The Panchayat has a
record of those who have domiciled in the village but not of those who
are in the village on purely temporary basis for construction , labour
etc, he said.

This meeting could be an example for other Panchayats to follow unless
they have a better model.

Below are some draft resolutions that can be adapted and adopted as
per the choice of each Gram Sabha. There are more in the attachment.
The Saligao Gram Sabha will be meeting on Sunday, 18 January, 2009. So
is the one in Navelim. Some other Panchayats will be meeting later
this month or in early February, 2009. These draft resolutions the
product of interaction among various village groups and back-and-forth
revision with inputs from Mr. Aravind Bhatikar, Sabina Martins,
Abhijit Prabhudesai, Geraldine Fernandes, Reboni Saha, Soter D'Souza,
Miguel Braganza and others. They are indicative, not exhaustive.

Each Gram Sabha is free to re-draft them or change them altogether to
meet its needs. In fact, some groups have already circulated their own
drafts saying more of less the same thing. It is important to give 72
hours [3 days] advance notice to the Panchayat of the proposal to move
the resolution or discuss the issue. Last moment resolutions are okay
if the Panchayat is cooperative.

These resolutions are circulated in public interest. No credit is
sought or expected. If the character of each village is protected,
each one of us will have a better Goa. Therein lies the common
interest of all those who love Goa.

   DRAFT RESOLUTIONS FOR GRAM SABHA MEETING

The Gram Sabha of village ............ ... of  ...........taluka, Goa,
on ….. January, 2009, to in the 58th year  of the Indian Republic and
the Constitution of India  that gives primacy to "The People of India"
do hereby resolve as under:

 1. The Village Panchayats should write to the TCP Department to
provide all the plans, maps and other documents to the Panchayat and
depute its Town Planner and supporting staff, including surveyors and
draughtsmen, to assist and enable the Village Committee on RP 2021 to
read the maps, do ground truth verification of the maps, Participatory
Rapid Appraisals [PRAs] to assess the people's felt needs, problems
and perceptions of "sustainable development" and to prepare a
perspective plan for the horizon year 2021.

2. The Government of Goa [represented by the CM and CS] should
constitute an "Appellate Authority" headed by a judicial officer,
nominated by the Panaji Bench of the Bombay High Court, to adjudicate
in case of dispute arising from the Gram Sabha resolution between the
Village Panchayat and the Director of Panchayats, or his subordinate
to whom the quasi-judicial powers are currently delegated as "Apellate
Authority.

 3. Government should freeze the FAR at VP3 level for villages as
already suggested in draft RP-21, until the final notification of
RP-2021.

4. That the Government of Goa keep open for public inspection the
Final Draft Regional Plan 2021, combining the two District Plans and
covering all the eleven Talukas of Goa, for a period of 30 days before
notifying the same for implementation.

5. The Government should freeze the operation of all notified ODPs and
put on hold the notification of pending ODPs, till the final
notification of RP-2021. The Government should take care to ensure
that ODPs are in consonance with RP-2021.

6. The Government should amend the Town and Country Planning Act
1974to incorporate the 73rd and 74th Amendments to the Constitution.
The Government of Goa, in the Legislative Assembly session convened in
February, 2009, should move a Bill on the lines of the draft TCP Bill,
1998, to bring the TCP Act in consonance with the Constitution of
India as amended in 1992

 7. The Amendments already carried out to Section 16 and16A to the TCP
Act  1974  vide the TCP [Amendment] Act, 2008 and the Ordinance of the
same title dated 29 February, 2008,  should be repealed with
retrospective effect as these amendments defeat the very purpose of
planning and are  in violation of the 73rd and 74th Amendment to the
Constitution. All cases sanctioned under the amendment must  be
reviewed.
